A nurse from Croydon who was involved in a dispute over using incorrect pronouns for a transgender patient has successfully obtained a settlement from the NHS trust employing her. Jennifer Melle, aged 41, received a written warning in May 2024 after referring to a transgender patient as "Mr" at St Helier Hospital in Carshalton, an incident during which she reported experiencing racial abuse from the patient.

Escalation and Suspension

Following the initial warning, Epsom and St Helier Hospitals NHS Trust also issued a letter to the patient, emphasizing that threatening and racist language would not be tolerated. However, the situation intensified when Ms Melle spoke to the media about her experience in March 2025, leading to her suspension with full pay. The trust expressed concerns that press reports could potentially identify the patient, thereby breaching patient confidentiality protocols.

Reinstatement and Settlement Agreement

After a private disciplinary meeting in January, Ms Melle was reinstated to her clinical duties with no further action taken regarding the alleged confidentiality breach. Recently, the trust agreed to settle her claim ahead of a tribunal scheduled to begin on April 13, as reported by the advocacy group Christian Concern. Ms Melle, who immigrated from Uganda and has worked at the hospital for twelve years, stated that she is relieved her employer has extended an olive branch, allowing her to focus on her nursing duties instead of defending against what she described as bizarre accusations.

Ongoing Professional Scrutiny

Despite the settlement, Jennifer Melle continues to face ongoing investigations by the Nursing and Midwifery Council. She emphasized that her ordeal highlights broader issues for medical professionals, asserting that nurses should be able to practice according to conscience, biological reality, and safeguarding principles without fear. Ms Melle recounted enduring the darkest days of her life, noting that the situation is far from over due to the pending NMC inquiries.

Trust's Response and Policy Stance

A spokesperson for Epsom and St Helier Hospitals NHS Trust reiterated that racial abuse against staff is unacceptable, and public discussion of a patient's private medical information is prohibited. The trust apologized for Ms Melle's experience and confirmed issuing a written warning to the patient involved. The spokesperson stressed the expectation that all staff maintain patient confidentiality consistently, underscoring the trust's commitment to both employee welfare and privacy standards.
