Alec Baldwin Civil Lawsuit Over Rust Shooting Cleared for Trial
A Los Angeles superior court judge has ruled that a civil lawsuit accusing actor Alec Baldwin of acting negligently in the deadly 2021 shooting on the set of the western film Rust can proceed to trial. The decision marks a significant legal development as Baldwin continues to face civil repercussions despite the dismissal of his criminal case earlier this year.
Judge's Ruling on Emotional Distress Claims
According to reports from Variety, Judge Maurice Leiter issued a summary judgment on Friday, allowing the case to move forward. In his ruling, Judge Leiter stated that "a reasonable jury could find that Mr. Baldwin recklessly disregarded the probability that pointing a gun in the direction of someone, with the finger on the trigger, would cause emotional distress." This finding underscores the court's view that the allegations warrant a full trial to determine liability.
Details of the Lawsuit and Shooting Incident
The lawsuit was filed by Serge Svetnoy, a gaffer on the Rust production, against the film's producers, including Baldwin, who served as both lead actor and a producer. Svetnoy alleges that he suffered emotional distress as a result of the shooting that killed cinematographer Halyna Hutchins and injured director Joel Souza. The incident occurred in October 2021 on the New Mexico film set when a prop gun held by Baldwin discharged a live round.
Baldwin has consistently maintained that he was told the gun was "cold," meaning it contained no live ammunition, and he has contended that he did not pull the trigger. However, the civil lawsuit focuses on claims of negligence rather than criminal intent.
Background and Other Legal Proceedings
This ruling follows the dismissal of Baldwin's involuntary manslaughter case in 2024, after a New Mexico judge determined that state prosecutors had withheld evidence. Despite that dismissal, Baldwin remains entangled in multiple civil lawsuits related to Hutchins' death and Souza's injuries.
Several other lawsuits have already been settled. In 2023, Hutchins' family reached a settlement with the film's producers, including Baldwin. Additionally, three crew members settled with producers and Baldwin in 2025. Meanwhile, the film's armorer, Hannah Gutierrez-Reed, was found guilty of involuntary manslaughter in March 2024 and sentenced to 18 months in prison; she was released in May 2025.

Variety reported that Svetnoy's case could potentially be settled before trial, which is tentatively scheduled for October 12.
