Major League Soccer Suspends Philadelphia Union Executive Following Misconduct Investigation

Major League Soccer has announced the suspension of Philadelphia Union sporting director Ernst Tanner without pay through 1 June 2026. The disciplinary action comes after an independent investigation substantiated violations of league policies and professional conduct standards.

Investigation Details and Substantiated Violations

The league initiated its investigation in mid-November following a Guardian report that detailed wide-ranging allegations of misconduct during Tanner's tenure with the Union. "Based on new information obtained during outside counsel's independent review, the investigation substantiated violations of MLS policies and standards of professional conduct required of League and Club leadership," MLS stated in an official announcement.

This marked the second investigation into alleged misconduct by the executive. An earlier probe in 2025, prompted by a complaint from the MLS Players Association alleging racist, sexist, and homophobic behavior, had been unable to substantiate those specific claims. However, the Guardian's subsequent reporting outlined additional allegations and corroborated several within the MLSPA's original complaint, leading MLS to reopen the investigation with outside counsel.

Restorative Practices Requirement and Club Response

MLS has mandated that Tanner complete a league-approved restorative practices program before he can be reinstated to his position. The league has not disclosed specific details about what misconduct was substantiated during the investigation.

"Based on the findings from Major League Soccer's investigation, the Philadelphia Union supports the league's disciplinary action and restorative practices program for Sporting Director Ernst Tanner," the club stated. "The Union will evaluate the best and appropriate structure for the organization following the disciplinary process. The Philadelphia Union remains committed to maintaining a safe, respectful, and inclusive environment for everyone associated with our club."

Tanner's Response and Investigation Challenges

Throughout the process, Tanner has consistently denied all allegations against him. In November, he pledged full cooperation with the league investigation, stating he was "working to clear my good name and reputation." Following the suspension announcement, Tanner expressed regret "for the impact that this situation has had on the Philadelphia Union organization and its supporters," while maintaining pride in his work with the team and looking forward to his eventual return.

The investigation faced significant challenges, including potential witnesses being subject to non-disclosure agreements. Both the Union and the investigating law firm, Littler Mendelson, assured that anyone wishing to speak with league investigators would be permitted to "fully participate" without fear of legal repercussions.

Parallels to Previous MLS Discipline and Current Team Status

A source familiar with the investigation noted that Tanner's suspension duration closely mirrors the penalty given to former New England Revolution head coach Bruce Arena in 2023. Arena faced allegations of making "inappropriate and insensitive" comments and was required to complete a similar restorative practices process before eventually resigning from the Revolution and later joining the San Jose Earthquakes.

The suspension of Tanner's pay began with Monday's announcement, though it remains unclear whether he continued receiving compensation during the investigation period. Sources indicate that Tanner's initial leave was ordered by the Union organization rather than MLS directly.

On the field, the Union have struggled in the early 2026 season, becoming the first team in MLS history to go winless in their opening four matches after posting the league's best record the previous year. Academy director Jon Scheer will serve as interim sporting director during Tanner's suspension.

"MLS is committed to fostering an environment of respect, inclusion, and accountability," the league emphasized in its statement. "We will continue working to ensure our clubs reflect those principles at every level of the organization."
