Pensioner Beaten to Death After Confronting Intruder

A man has been sentenced to life imprisonment with a minimum of 20 years for the brutal murder of a 79-year-old pensioner who confronted him for loitering outside elderly residents' flats in East London.

Phillip Fraczek, now 22, was convicted of killing Franklin Agbotui, a retired merchant navy officer, at his flat in Plaistow Road, West Ham, on May 15, 2024. The attack occurred after Mr. Agbotui woke Fraczek, who had fallen asleep on the floor, and asked him to leave the premises.

At the time of the incident, Fraczek, a Polish national of no fixed address, had been trying door handles at the block of flats, alarming residents. After being confronted, he followed Mr. Agbotui into his flat, where neighbors heard banging noises and screams. The pensioner was found with severe injuries, surrounded by broken furniture, and died in hospital five days later.

Police officers apprehended Fraczek two streets away, during which he headbutted an officer in the jaw. His knuckles and Nike trainers were stained with Mr. Agbotui's blood. He later admitted murder and assault of an emergency worker at an earlier hearing.

At Snaresbrook Crown Court on Monday, Fraczek was jailed for life with a minimum term of 20 years and four months.

Detective Superintendent Kelly Allen of the Metropolitan Police described Mr. Agbotui as a kind and gentle man, known for tending flowers in the shared garden of his residence. He had a distinguished career in the Merchant Navy and enjoyed a peaceful retirement, which was violently cut short by Fraczek's unprovoked and savage attack.

Allen commended the officers who risked their safety to pursue and detain Fraczek, preserving crucial evidence. She expressed hope that the lengthy sentence would bring some peace to Mr. Agbotui's family and friends.

In a victim impact statement, Mr. Agbotui's family said: "Our father lived a quiet, humble life grounded in integrity, respect, perseverance, education and faith. He instilled these values in us consistently and led by example. Despite his modest nature, he was deeply present in our lives – offering guidance, checking in regularly and sending daily messages. He was a constant, steady source of support."

They added: "Beyond our immediate family, he was an active and valued member of his church community, where his absence has also been keenly felt. We continue to feel the absence of our father's kindness, his humour and his guidance. His death has had a profound and far-reaching impact on our wellbeing, our sense of stability and our family as a whole."
